Terms of Service

1. Eligibility

You must be at least 18 years old and authorized to enter into a binding contract on behalf of your organization to use the Platform. By using the Platform, you represent that you meet these requirements.

2. Description of Services

Inseyeghts provides an AI-powered call quality monitoring and intake training platform designed for law firms. Services include call transcription, AI scoring, violation flagging, agent scorecards, compliance audit trails, intake training roleplay, and related features. Features may be added, modified, or removed at any time at our sole discretion.

3. Account Registration

You must create an account to access the Platform. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at info@inseyeghts.com if you suspect unauthorized access to your account. Inseyeghts is not liable for any loss or damage resulting from unauthorized access to your account.

4. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose
• Reverse engineer, decompile, or attempt to extract the source code of the Platform
• Share your account credentials with unauthorized users
• Upload or transmit malicious code or interfere with the Platform's operation
• Use the Platform in any way that violates applicable federal, state, or local law
• Resell or sublicense access to the Platform without our written consent

5. Call Recording and Compliance

You are solely responsible for ensuring that your use of the Platform complies with all applicable call recording laws, including federal and state wiretapping and consent laws. Inseyeghts does not provide legal advice regarding call recording compliance. We strongly recommend consulting with qualified legal counsel before deploying the Platform and using a consent disclosure at the start of each recorded call. Inseyeghts is not liable for any claims, fines, or penalties arising from your failure to comply with applicable recording laws.

6. Subscription and Payment

Access to the Platform requires a paid subscription or pay-as-you-go usage. All fees are stated in U.S. dollars. By subscribing, you authorize Inseyeghts to charge your payment method on a recurring basis according to your selected plan. All fees are non-refundable unless otherwise stated in writing. Inseyeghts reserves the right to modify pricing at any time with 30 days written notice. Failure to pay may result in suspension or termination of your account.

7. Overage Charges

When your plan's included minutes are exhausted, the Platform will not automatically charge you for additional usage. Service will pause until you actively choose to continue. If you wish to continue using the Platform beyond your included minutes, additional usage will be billed at $1.00 per minute for AI call evaluations and $0.80 per minute for training calls. No overage charges will be applied without your explicit consent to continue. You are responsible for monitoring your usage in real time from the dashboard.

8. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing cycle. No refunds will be issued for unused time remaining in a billing period.

9. Intellectual Property

All content, software, algorithms, designs, trademarks, and materials on the Platform are the exclusive property of Inseyeghts LLC. Nothing in these Terms grants you any ownership rights in the Platform. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our prior written consent.

10. Data Ownership

You retain ownership of all call recordings, transcripts, and data you upload to or generate through the Platform. By using the Platform, you grant Inseyeghts a limited, non-exclusive license to process your data solely for the purpose of providing the services described in these Terms. Inseyeghts will not sell, share, or use your data for any purpose beyond providing the Platform.

11. Confidentiality

Both parties agree to keep confidential any non-public information shared in connection with the use of the Platform. Inseyeghts will not disclose your firm's data, call recordings, or usage information to third parties except as required by law or as necessary to provide the Platform.

12. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranty of any kind. Inseyeghts expressly disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be error-free, uninterrupted, or free of harmful components. AI-generated scores, findings, and recommendations are provided for informational purposes only and do not constitute legal advice.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Inseyeghts LLC and its members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, loss of data, or business interruption, arising out of or related to your use of the Platform, even if advised of the possibility of such damages. In no event shall Inseyeghts's total liability to you exceed the amount you paid to Inseyeghts in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Inseyeghts LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any applicable law or regulation.

15. Termination

Inseyeghts reserves the right to suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to access the Platform immediately ceases. Inseyeghts is not liable to you or any third party for termination of your access.

16. Modifications to Terms

Inseyeghts reserves the right to modify these Terms at any time. We will notify you of material changes by email or through the Platform. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in California.

18. Dispute Resolution

In the event of any dispute arising out of or related to these Terms or the Platform, the parties agree to first attempt to resolve the dispute informally by contacting Inseyeghts at info@inseyeghts.com. If the dispute cannot be resolved informally within 30 days, it shall be submitted to binding arbitration in California under the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.
